COMPETITION RULES – FACEBOOK 2020
The games organized on the Facebook® K’line page are free and without obligation to purchase.
By taking part in the various games via the Facebook® page of the K’line brand, participants will be able to access the draw allowing one of them to win a prize, the nature of which is indicated within each contest publication concerned. The games are accessible on K’line’s Facebook® gaming platform at the following address: https://www.facebook.com/blog.de.kline/ (hereinafter the “Platform”).
It is specified that the Contest Game is developed and managed by K’line to the exclusion of any sponsorship or intervention by the Facebook® company, only ensuring the hosting of the Contest Game within its Platform.
This document is the rules of the Contest, hereinafter referred to as the “Rules”. It can be supplemented and/or modified at any time during the duration of the Game, by any additional clause which will come into force by the mere fact of its publication online by K’line.
Any person is deemed to have read, understood and accepted, without reservation, the Rules in their entirety, and in particular the article relating to personal data as soon as they access and register for the Game.
All of the aforementioned documents are made available and accessible to any user and participant for the duration of the Game. They are asked to make a backup copy and/or print all of the aforementioned texts in order to be able to refer to it, if necessary.
Article 1: Conditions of access
1.1. Participation in the Contest is open to anyone meeting the cumulative conditions below:
(i) natural and adult person,
(ii) has internet access and a valid personal email address,
(iii) having a Facebook® account and accessing the Contest via the Facebook® K’line Gaming Platform for the duration indicated in the game publication concerned, at the following address https://www.facebook .com/blog.de.kline/
K’line will, within the limits of the means at its disposal, verify compliance with these criteria. In the event that one of these criteria is not met, registration for the Contest Game cannot be validated.
1.2. Participation in the Contest Game is limited to registration for the draw as detailed in article 2 below.
Article 2: Participation
2.1. The Contest Game is open to anyone who meets all the conditions mentioned in article 1.1 above.
To register for the draw and try to win the prizes at stake in article 3.1, all participants must have carried out the actions mentioned below:
– Go to the page https://www.facebook.com/blog.de.kline/
– Go to one of the dedicated publications
– Follow the detailed participation instructions in the dedicated publication
– Read, understand and unreservedly accept the Game Rules available in the “Articles” tab of the aforementioned Facebook® page.
Registration for the draw is effective only at the end of these steps.
It is understood that each participant undertakes to reveal correct information concerning him. K’line disclaims all liability in the event that a participant uses false names and/or first names associated with a valid e-mail address, or even usurps the identity of a third party.
2.2. Participation in the Contest Game is carried out exclusively electronically on K’line’s Facebook® game platform in an exclusive manner, the draw being carried out among the participants registered for the latter.
Any participation in the Contest on plain paper or in any other form is excluded.
2.3. Participation in the Contest will only be valid if the information required by K’line is complete and correct.
All registrations made using incorrect or falsified information or via counterfeit or falsified forms will automatically forfeit any right to obtain any winning prize.
2.4. All participants undertake to comply with the Rules. Any non-compliance with the Rules by the Participant, and in particular any fraud, abuse, cheating by him, may result in his exclusion from the Game by decision of K’line.
In addition, in the presence of abuse or cheating by one or more participants, K’line reserves the right to modify or terminate the Contest without notice, in particular when the integrity of the Contest is questioned in its object. .
Article 3: Determination of winners – distribution of prizes
The winner will be determined by drawing lots between the participants via Facebook. This winner wins the prize indicated in the dedicated publication available on the Platform. Participants may not claim any compensation or compensation whatsoever in the event of cancellation or loss other than any compensation offered by the organizer. The lot offered cannot give rise to any dispute of any kind, nor to the delivery of the equivalent in money, nor to the exchange or replacement for any reason whatsoever by K’line. If circumstances so require, K’line reserves the right to replace the prize with other prizes of equivalent value.
3.2. Determination of winners
The winner will be determined by a draw which will be carried out on the date mentioned in the dedicated publication, in the database of people registered for the draws.
3.3. Information of the winners / award ceremony
K’line will notify the winners electronically on the day of the draw. On this occasion, the winners will be notified of the terms and conditions for taking possession of their prize.
The winners must use their prize from the date indicated. If they are not returned on time, the winners will lose their prize without K’line being held liable, nor any compensation due.
Notwithstanding the foregoing, the organizing company also reserves the right to retain the prizes that should have been awarded to the defaulting winner and to dispose of them as it wishes.
Article 4: Modification / termination of the Contest
4.1. K’line reserves the right to shorten, extend, modify or cancel the Contest in the event of a case of force majeure which would make it impossible to continue the Contest in accordance with the provisions of the Rules and in particular in malfunction of the Internet network (due to a virus or not), the Platform or any other problem related to networks, means, and (tele)communication services, computers (online or not), servers, providers of Internet access and/or hosting, computer equipment or software, data or databases.
4.2. In the event that such cancellation, modification, extension or reduction of the duration of the Contest should occur, K’line undertakes to notify the participants by e-mail and/or by publication within the Platform via the dedicated application and, if necessary, to communicate to them the new applicable rules or the new closing date of the Contest.
In the presence of modification of these Rules with regard to the preceding mentions, the continuation of the Contest Game by the registered participants will be worth acceptance of the modifications made, each participant having the possibility of unsubscribing from the Contest Game by contacting K’line.
4.3. In the event of modification of the conditions of the Contest Game, cancellation, interruption or reduction of the duration of the Contest Game, the responsibility of K’line cannot be engaged and the participants cannot claim any compensation, which ‘they accept.
4.4. Each of the Participants finally accepts that K’line may terminate the Contest Game, or make changes to it at any time in the event that it finds a significant number of abuses and cheating, whether during registration for the Contest Game. or its very course.
The cancellation or modification of the Contest Game will be communicated to the participants by publication on the Platform or by any means that K’line deems appropriate.
Article 5: Exoneration and limitation of liability
K’line cannot be held liable for damages, direct or indirect, whatever the causes, origins, natures or consequences, even if it has been advised of the possibility of such damages, caused for reason:
(i) malfunction of the Internet network or computer equipment, including the Platform and the application (hardware and/or software and/or databases and/or data) of a Participant or any person or company related to the organization of the Competition or, more generally, any other problem related to networks, means and services of (tele)communications, computers (online or not), servers, access providers and/or hosting the Internet, computer equipment or software, databases and data of anyone;
(ii) the veracity of the information given by the Participant, and which it could not validly consider as not respecting the provisions of these rules and the Conditions of Use with regard to the information and means in its possession;
(iii) any manufacturing defect, breakdown or other malfunction, the compliance of the lots with the standards to which they may be subject or the safety of use of the lots offered (under normal conditions of use) which would not be its own products.
K’line declines all responsibility for damage caused by events beyond its control, resulting from the use of the lot, or the service of a supplier.
Article 6: Participation fees
The Contest Game is free and without obligation to purchase.
The Rules are made available to participants free of charge on the Platform dedicated to the Game.
For participants accessing the Contest via a modem and by means of a telephone line billed according to the time spent – i.e. excluding cable, ADSL or specialized link subscriptions and package including or offering communication costs – the Site connection costs incurred for participation in the Contest will not be reimbursed to participants.
Article 7: Dispute
In the event of a dispute or complaint concerning the Contest Game for any reason whatsoever, requests must be sent in writing to the attention of K’line by email to pascaline @ bargeo.fr, for the duration of the Contest Game and maximum within sixty (60) days after the designation of the winners.
In the event of a dispute or complaint concerning the prizes awarded, requests must be sent in writing to the attention of K’line, by e-mail to pascaline @ bargeo.fr or by post to the address mentioned in the preamble in a period of seven (7) days after receipt of the price confirmation.
Each participant agrees in the event of any difficulty that may arise regarding the application or interpretation of the Rules, to make an amicable appeal to K’line prior to any legal action against the latter.
The Rules are subject to French law. In the event that no amicable solution is found between the participant(s) and K’line, any dispute arising from these Rules will be submitted to the French courts.
Article 8: Personal data
In accordance with the provisions of the law of August 2, 2002 relating to the protection of persons with regard to the processing of personal data, files and freedoms, as well as all the texts relating to the execution of the provisions which are provided, the participant is informed that all the information requested in the registration form for the Contest Game is mandatory, and mentioned as such, and that failure to answer these questions by the participant will prohibit him from participating in the Game. .
The data collected is strictly necessary for the proper completion of the Game. Any use for purposes other than those expressed in these Rules must be expressly authorized by the participant. By participating in the Game, the participant accepts the Rules and the collection of said data. The data will be deleted within 3 months following the end of the Contest Game, unless otherwise expressly agreed by the participant.
K’line may publish and reproduce on the Platform the image, the recording of the voice and the name of the winner, provided that the latter consents thereto at the request of K’line.
Consequently, the data collected is transmitted only to K’line.
All Participants also have the right to access, rectify, block and delete data concerning them by contacting K’line directly by e-mail at the address pascaline @ bargeo.fr.
It is specified in this respect that any request to delete this data by any means whatsoever during the duration of the Contest Game may result in the cancellation of registration for the Contest Game.
Article 9: Electronic evidence agreement
K’line may rely, in particular for the purposes of proof of any act, fact or omission, of the programs, data, files, recordings, operations and other elements of nature or in computer or electronic format or medium, established, received or stored directly or indirectly by it or the participants, except abuse or manifest error. Participants undertake not to contest the admissibility, validity or probative force of the elements in format or computer or electronic medium mentioned above. Thus, the elements considered constitute evidence and, if they are produced as evidence by K’line in any contentious or other proceedings, they will be admissible and enforceable between the parties in the same way, under the same conditions and with the same probative force as any document drawn up, received or kept in writing.
